leasesify Platform Terms of Use

1. Acceptance of Terms

Accessing or utilizing the leasesify service ("Platform") signifies your express acceptance of these Terms and Conditions ("Terms") and your agreement to comply with and be legally obligated by them. In the event you are acting in a representative capacity for a corporation, partnership, or any other business entity when accessing or using the Platform, you expressly warrant and covenant that you are duly authorized to enter into these Terms on behalf of such entity and to legally bind it hereto.

2. Account Registration

a. Provide accurate, current information during registration.

b. Safeguard your login credentials.

c. Notify us immediately of unauthorized account use.

3. Platform Services

As part of its core service offering, leasesify provides Users with proprietary digital tools and functionalities accessible via its online platform. These tools facilitate the creation, ongoing management, and secure digital storage of lease agreements and associated documents.

4. User Responsibilities

Users of the Leasesify Platform agree to the following obligations:

a. Lawful and Ethical Use: Utilize the Platform and Services solely for lawful purposes and in strict accordance with ethical business practices.

b. Data Accuracy: Exercise reasonable diligence to ensure the completeness, truthfulness, and accuracy of all lease data, information, and documentation submitted to or processed through the Platform.

c. Legal Compliance: Comply fully with all applicable governed by laws of the Hong Kong Special Administrative Region statutes, regulations, ordinances, and industry standards governing their activities, including but not limited to data protection and privacy laws and residential/commercial landlord-tenant regulations.

d) Consent Requirement: Landlords utilizing the leasesify platform must obtain prior, explicit, informed, and legally valid consent from their Tenants before uploading, submitting, processing, or storing any Tenant Personal Data or lease agreement information (collectively, "Tenant Data") within the leasesify Platform using any feature or function.

e) Landlord's Sole Responsibility: The Landlord is solely and exclusively responsible for:

(i) Determining the lawful basis for processing Tenant Data;

(ii) Obtaining and managing all necessary consents, authorizations, or permissions from Tenants;

(iii) Ensuring the accuracy and lawfulness of the Tenant Data provided; and

(iv) Complying with all applicable landlord-tenant laws and data protection regulations concerning the collection, use, and disclosure of Tenant Data.

(f) Leasesify's Role & Disclaimer:

Leasesify acts as a data processor (or service provider) solely on the instructions of the Landlord (the data controller/business) regarding Tenant Data and relies entirely on the Landlord's representations and warranties regarding their lawful authority to process Tenant Data through the Platform and the validity of obtained consents.

(g) LEASESIFY EXPRESSLY DISCLAIMS ANY AND ALL LIABILITY arising from a Landlord's failure to obtain proper Tenant consent, provide accurate information, or otherwise comply with applicable laws regarding Tenant Data. Landlords agree to indemnify and hold Leasesify harmless from any claims, damages, or penalties resulting from such failures.

(h) Landlord Warranty: By uploading or processing any Tenant Data on the leasesify Platform, the Landlord expressly warrants and represents that they have obtained all necessary consents and authorizations from the relevant Tenant(s) in full compliance with applicable law, and that they are legally entitled to instruct Leasesify to process such data.

5. Third-Party Links & Content

The Platform may include links to external websites, services, applications, or content controlled by third parties ("Third-Party Offerings"). Your access to and use of any Third-Party Offering is solely at your own risk. leaesify/We (a) Does not endorse, approve, monitor, or warrant the accuracy, legality, quality, or any other aspect of any Third-Party Offering; and (b) To the fullest extent permitted by applicable law, disclaims all liability for any loss, damage, or harm (direct, indirect, incidental, consequential, or otherwise) arising from or related to your use of or reliance on any Third-Party Offering.

6. User Responsibilities and Prohibited Activities

You agree to solely responsible for your use of the Platform and any content or data you provide. You hereby agree and warrant that you shall: (a) Use the Platform exclusively for lawful purposes in strict compliance with these Terms and all applicable ethical standards;(b) Ensure that all lease data and other information provided to or through the Platform is accurate, complete, current, and legally compliant. You bear sole responsibility for verifying such information; (c) Comply fully with all relevant laws, statutes, ordinances, rules, and regulations, including without limitation data privacy and security laws, consumer protection laws, and tenancy/housing regulations applicable in your jurisdiction; (d) Absolutely refrain from, and shall not permit others to, engage in any of the following Prohibited Activities: (i) Uploading, sharing, or transmitting any content that is unlawful, harmful, threatening, abusive, harassing, defamatory, vulgar, obscene, invasive of privacy, or otherwise objectionable; (ii) Violating, infringing, or misappropriating the intellectual property rights, rights of publicity, privacy rights, or contractual rights of any third party; (iii) Attempting to gain unauthorized access to the Platform, its systems, or other users' accounts; interfering with, disrupting, or creating an undue burden on the Platform's infrastructure or functionality; or transmitting viruses, malware, or any other malicious code.

7. Removal of User Content

leasesify reserves the unconditional right, at its sole discretion and without liability, to review, monitor, remove, or disable access to any content submitted, posted, or stored by users on the Platform. We may take such action immediately and without prior notice if the content, in our judgment:

(a) Violates these Terms and Conditions or any applicable law, regulation, or third-party right;

(b) Is harmful, threatening, abusive, harassing, defamatory, deceptive, fraudulent, obscene, or otherwise objectionable; or

(c) Compromises the security, integrity, functionality, or reputation of the Platform or its users.

8. Payments & Subscriptions Management

a. Automatic Renewal:

Subscriptions recur leaesing contract end date or monthly based on your selection. By providing payment details, you authorize recurring charges at each renewal. Fees are billed at the start of each Billing Cycle.

b. Cancellation Policy:

To prevent auto-renewal after end date of agreement, cancellation must be completed ≥30 days pre-renewal via the Platform's designated method. Partial-cycle refunds are excluded upon mid-cycle cancellation.

c. Refund Conditions:

Refund eligibility is strictly limited to the terms in our Refund Policy. We disclaim all liability for refunds beyond policy stipulations.

9. Disclaimers and Liability Restrictions

9.1 No Warranties

WE EXPRESSLY DISCLAIM ALL WARRANTIES OF ANY KIND, WHETHER ORAL OR WRITTEN. NO ADVICE OR INFORMATION FROM US SHALL CREATE ANY WARRANTY NOT EXPRESSLY STATED HEREIN.

9.2 Liability Exclusion

NEITHER WE NOR OUR AFFILIATES SHALL BE LIABLE FOR:

(a) CONSEQUENTIAL, INCIDENTAL, OR SPECIAL DAMAGES (E.G., BUSINESS INTERRUPTION, LOST OPPORTUNITIES);

(b) CLAIMS RELATED TO LEASE AGREEMENT ENFORCEMENT, TENANCY DISPUTES, OR USER-NEGOTIATED TERMS;

(c) DAMAGES EXCEEDING THE SUBSCRIPTION FEES PAID DURING THE CURRENT TERM.

THESE LIMITATIONS APPLY TO ALL CAUSES OF ACTION (CONTRACT, TORT, NEGLIGENCE, OR OTHERWISE).

10. User Indemnification Obligation

You shall defend, indemnify, and hold Leasesify (including its subsidiaries, successors, and assigns) harmless against all losses, liabilities, damages,judgments, settlements, costs, and expenses (including reasonable legal fees) resulting from:

(i) Your unauthorized use of the Platform or violation of these Terms;

(ii) Your infringement of any intellectual property, privacy, or contractual rights;

(iii) Your negligence or wilful misconduct; or

(iv) Any content or data you submit through the Platform.

This obligation survives termination of your account.

11. Modification

We may amend these Terms periodically to reflect:

(a) Changes in our services or business practices;

(b) Legal or regulatory requirements; or

(c) Security or operational necessities.

Material modifications will be communicated through prominent Platform notifications and/or registered email at least thirty (30) days before implementation. Non-material changes become effective immediately upon posting. Continued access or use after the effective date constitutes your irrevocable acceptance.

12. Account Suspension and Termination

12.1 Grounds for Termination

We reserve the right to suspend or terminate your access to the Platform without liability:

(i) For material breaches of Sections 6-8 [User Responsibilities/Content/Payments];

(ii) Upon evidence of fraud, security threats, or illegal activity;

12.2 Effects of Termination

Upon termination:

(a) All subscription fees become immediately due;

(b) You must cease all Platform use;

13. Governing Law & Severability

a. These T&Cs are governed by laws of the Hong Kong Special Administrative Region.

b. If any provision is deemed unenforceable, it shall be severed without affecting remaining terms' validity.

14. Intellectual Property Rights

14.1 All Platform components (including software architecture, graphical assets, API structures, and know-how) constitute leasesify's confidential proprietary property.

14.2 Prohibited Acts

Expressly prohibited without authorization:

(a) Copying beyond normal Platform use;

(b) Creating mirror sites or derivative services;

(c) Scraping, crawling, or data extraction;

(d) Circumventing technical protection measures.

14.3 Data Rights

User Data remains your property. You grant: A sublicensable license for third-party integrations;Irrevocable rights for archival/legal compliance; Processing rights under GDPR Article 6(1)(b).

15. Modification of Terms

The Company may modify these Terms and Conditions periodically. Such modifications shall be effective immediately upon posting the updated terms on this Website. Your continued use of the Website following such posting constitutes binding acceptance of the amended terms.
